Terms of Service
Last updated: October 27, 2026
Welcome to mmai.media (the "Site"), operated by MMAI Media LLC ("MMAI Media," "we," "us," or "our"), a limited liability company based in San Francisco, California. These Terms of Service (the "Terms") govern your access to and use of the Site and the newsletter, videos, devlogs, game demos, podcasts, blog posts, and other content and services we make available through it (together, the "Services"). Please read them carefully.
Key points
- You must be at least 13 years old to use the Services.
- We own everything we publish: our game assets, code, videos, art, music, writing, and branding. You may view and play for yourself. Copying, re-uploading, extracting assets, selling, or using our content to train AI is not allowed without written permission.
- Devlogs, demos, and early builds are provided "as is" and may be buggy, unfinished, or change.
- Our liability to you is limited, as described below.
- These Terms are governed by California law.
Acceptance of These Terms
By accessing or using the Services, or by subscribing to our newsletter, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms. If you do not agree, do not use the Services.
Eligibility and Age Requirement
You must be at least 13 years old to use the Services, including subscribing to our newsletter. If you are under 13, you may not use the Services or give us any personal information. If we learn that someone under 13 has used the Services or given us personal information, we will end their access and delete the information.
If you are at least 13 but under 18 (or under the age of majority where you live), you may use the Services only with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. In some countries, the minimum age to consent to the processing of personal data online is higher than 13; see our Privacy Policy.
By using the Services, you represent that you meet these requirements and that you are not barred from using them under applicable law.
The Services
The Services currently include information about MMAI Media, a newsletter signup, and links to our content on third-party platforms. Over time they may include videos, blog posts, podcasts, devlogs, game demos, and other content. We may add, change, suspend, or discontinue any part of the Services at any time, without notice or liability to you. The Site's availability is not guaranteed.
Intellectual Property Ownership
Our Content
"Our Content" means everything we create, publish, or make available through or in connection with the Services, including:
- Game Assets: software, source code and object code, game builds, demos, prototypes, alpha and beta versions, tools, scripts, shaders, 2D and 3D art, sprites, models, textures, animations, user interface designs, music, sound effects, voice recordings, level and world designs, characters, stories, game mechanics, design documents, and devlog materials;
- Video Content: videos, shorts, livestreams, and recordings published on YouTube or elsewhere, including their footage, scripts, narration, graphics, animations, music, sound design, thumbnails, titles, descriptions, captions, and channel branding;
- Site Content: text, blog posts, podcast audio, images, graphics, layout, design, and the Site's software and source code; and
- Brand: the "MMAI Media" name, our logos, and our other trademarks, service marks, and trade dress, whether or not registered.
Ownership
As between you and us, MMAI Media LLC and its licensors exclusively own all right, title, and interest in and to Our Content, including all copyrights, trademarks, trade secrets, and other intellectual property rights worldwide. Our Content is protected by United States and international copyright, trademark, and other laws. Nothing in these Terms or in your use of the Services transfers any ownership of Our Content to you or grants you any license or right in it, whether by implication, estoppel, or otherwise, except the limited license below. All rights not expressly granted are reserved. Publishing Our Content on a third-party platform, or making it available for free, does not waive or transfer any of our rights.
Limited license to you
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Site and Our Content, and to play and evaluate any demo we make available, solely for your own personal, non-commercial use. This license ends automatically if you breach these Terms, and we may revoke it at any time. You may link to the Site and to our content on third-party platforms. Sharing or embedding through a platform's own built-in features is governed by that platform's terms and the settings we choose.
Restrictions
Except as these Terms expressly allow, or where applicable law gives you a right that cannot be waived by contract, you must not, and must not allow anyone else to:
- copy, reproduce, republish, mirror, upload, post, stream, broadcast, or distribute any of Our Content, in whole or in part, including by re-uploading or re-posting our videos on any other channel, platform, or service;
- sell, rent, lease, sublicense, or otherwise commercially exploit Our Content, or use it in any monetized or commercial content, product, or service, without our prior written consent;
- modify, adapt, translate, remix, or create derivative works from Our Content;
- extract, rip, unpack, datamine, or reuse any Game Assets (including art, audio, models, code, or data) from any demo, build, video, or screenshot;
- reverse engineer, decompile, or disassemble any software or build we provide, or try to derive its source code, algorithms, or file formats, or circumvent any technical protection or access control;
- use Our Content, or any data derived from it, to train, fine-tune, test, or improve any machine-learning or artificial intelligence model, or for text and data mining, whether manually or by automated means. We expressly reserve all rights in Our Content for these purposes, including the right to opt out of text and data mining under applicable law, such as Article 4 of EU Directive 2019/790;
- remove, alter, or obscure any copyright, trademark, watermark, or other proprietary notice;
- use the Brand, or anything confusingly similar, in a name, logo, domain name, channel name, handle, or product name, or in any way that suggests affiliation with or endorsement by us; or
- present Our Content as your own.
To request permission for any use beyond the limited license, email info@mmai.media. Permission is effective only if given in writing by MMAI Media. Source code or other materials we publish in a code repository are also governed by the license in that repository.
Third-party materials
Some material shown or used in Our Content, such as game engines, licensed music or assets, and brand names, footage, or images of other companies' games shown for commentary or education, belongs to third parties and is used under license or applicable law. Those owners keep their rights, and nothing in these Terms gives you any right in their materials.
Game-specific and platform terms
If a particular game or demo comes with its own license agreement or terms (for example, on a game distribution platform), those terms also apply to that game or demo. If they conflict with this section as to that item, the game-specific terms control, but they never transfer ownership of Our Content to you.
Feedback
If you send us ideas, suggestions, bug reports, or other feedback, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use it for any purpose without credit or compensation to you. You represent that you have the right to give us this feedback.
Enforcement
We take the protection of Our Content seriously. Violations may result in immediate termination of your access, takedown notices to platforms, and legal action, including claims for damages. You acknowledge that unauthorized use of Our Content may cause us irreparable harm for which money damages would be inadequate, and that we may seek injunctive or other equitable relief, to the extent permitted by law, without posting a bond. If you see Our Content being used without permission, please tell us at info@mmai.media.
Third-Party Services
The Services rely on and link to third-party services that we do not own or control. By using the Services, you acknowledge and agree to the following.
Brevo (email processing)
We use Brevo to collect and store newsletter subscriptions and to send our emails. When you submit the signup form, your email address and related subscription information are transmitted to and processed by Brevo on our behalf, in accordance with Brevo's Privacy Policy and terms. How we and Brevo handle your information is described in our Privacy Policy. You may unsubscribe at any time, as described under Newsletter.
YouTube (video embeds)
Our video content is hosted on YouTube, and we embed YouTube videos on the Site. Embedded videos are delivered by YouTube, not by us. By viewing or playing an embedded video, you acknowledge that YouTube (operated by Google) may collect information about you and set cookies as described in the Google Privacy Policy, and you agree to be bound by the YouTube Terms of Service. Embedded videos remain Our Content under Intellectual Property Ownership; embedding does not give you any rights in them beyond what YouTube's terms expressly provide for use of its features. We are not responsible if a video is unavailable, removed, restricted, or altered by YouTube.
Other third-party services and links
The Services also use or link to other third-party services, such as Google reCAPTCHA and Google Fonts, our hosting providers, and platforms like Spotify, Patreon, Itch.io, Substack, Ko-fi, and social networks. Your use of those services, including any purchase, membership, download, or subscription, is solely between you and the provider and is governed by its terms and policies. We do not endorse, control, or accept responsibility for third-party services or their content, availability, or practices, and we are not a party to your dealings with them. This does not limit any obligation we have under applicable data protection law.
Acceptable Use
You agree not to:
- use the Services in violation of any law or these Terms, or to infringe anyone's rights;
- submit an email address that is not yours, or any false or misleading information;
- use bots, scrapers, or other automated means to access the Services, submit the signup form, or collect content or data from the Site, other than search-engine indexing that follows our robots.txt file;
- interfere with or disrupt the Site, its servers, or its networks, or probe, scan, or test its security without our written permission;
- attempt to gain unauthorized access to the Site, our accounts, or other users' information;
- introduce malware or other harmful code, or impersonate any person or entity.
Devlogs, Demos, and Educational Content
Work in progress
Devlogs, demos, prototypes, alpha and beta builds, previews, and other early-stage content ("Early Content") are unfinished. They may contain bugs, glitches, crashes, incomplete or placeholder material, performance problems, and errors. They may change, pause, or be withdrawn or discontinued at any time, with or without notice. We make no promise to release, finish, update, support, or maintain any game, demo, or feature, or that the final product will resemble what is shown, and nothing in Early Content is a commitment about release dates, features, or pricing.
"As is" provision
Early Content, and everything you download or play through the Services, is provided "as is" and "as available." You use it at your own risk. You are responsible for your own devices, backups, and data, including save files, which may fail to save or become corrupted. Download only from our official links and pages, and scan downloads for malware. We are not responsible for modified copies or unofficial mirrors. The Disclaimer of Warranties and Limitation of Liability below apply to Early Content.
Educational content
Our videos, podcasts, blog posts, and other content about game theory, artificial intelligence, game design, and related topics are for general informational, educational, and entertainment purposes only. They are opinions and explanations, not professional advice of any kind (including financial, investment, legal, or medical advice), and they may contain errors or become outdated. We do not guarantee their accuracy or completeness, and you rely on them at your own risk.
Disclaimer of Warranties
THE SERVICES AND ALL CONTENT, DEVLOGS, DEMOS, PROTOTYPES, BUILDS, AND DOWNLOADS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMAI MEDIA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES OR ANY DEMO WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR ANY DOWNLOAD ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICES, AND PLAY OR DOWNLOAD ANY DEMO, ENTIRELY AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MMAI MEDIA LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS (THE "MMAI PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES (INCLUDING ANY DEVLOG, DEMO, OR DOWNLOAD), WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE MMAI PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE, AND (B) ONE HUNDRED U.S. DOLLARS (US $100).
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND YOU AND MMAI MEDIA AGREE THEY ARE AN ESSENTIAL BASIS OF THE BARGAIN.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless MMAI Media LLC and its members, managers, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your violation of any law or third-party right, or your misuse of Our Content.
Termination
We may suspend or terminate your access to the Services, or remove you from our mailing list, at any time and for any reason, including if we believe you have breached these Terms. You may stop using the Services at any time and may unsubscribe from the newsletter at any time. The sections of these Terms that by their nature should survive termination will survive, including Intellectual Property Ownership, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law and Venue.
Governing Law and Venue
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. You and MMAI Media agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, and you waive any objection to personal jurisdiction or venue in those courts.
If you are a consumer, nothing in this section removes any mandatory consumer-protection rights you have under the laws of the country where you live.
Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page with a new "Last updated" date and, for material changes, may also give notice on the Site or by email. By continuing to use the Services after the revised Terms are posted, you accept them. If you do not agree, stop using the Services.
General
- Entire agreement. These Terms, our Privacy Policy, and any game-specific terms described above are the entire agreement between you and us about the Services.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the rest of these Terms will remain in effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of it.
- Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets.
- Notices. We may give you notice by posting on the Site or by email to an address you gave us.
